Maintenance Recovery Process

The recovery of maintenance dues from members in a Cooperative Housing Society in Karnataka is governed by the Karnataka Co-operative Societies Act, 1959 (KCS Act). When a member fails to pay maintenance charges, the society can initiate a formal, accelerated recovery process under Section 101 of the Act, which empowers the Registrar to issue a recovery certificate allowing dues to be treated as land revenue.

Key Aspects of the Recovery Process

  • Defaulter Definition: A member who fails to pay dues for three consecutive months is considered a defaulter.
  • Interest: Societies can levy interest (up to 24% per annum, depending on bylaws) on delayed payments.
  • Final Remedy: If notices fail, the Registrar can issue a recovery certificate, leading to the attachment and auction of the member's property.

MAINTENANCE GUIDELINES

1. Title, Applicability and Authority

These Guidelines shall be called "Maintenance Guidelines of The County Address Villa Owners/ Resident Co-operative Society Limited" and shall apply to all members, associate members, occupants, tenants, and users of the Society's property. They are framed in accordance with the Karnataka Co-operative Societies Act, 1959, Rules, 1960, and the Society Bye-laws and shall come into force immediately upon approval by the General Body.

2. Objectives

The objectives of these Guidelines are to ensure proper upkeep, safety, hygiene of Society property, transparency in maintenance charges, clarity of responsibilities, and prevention of disputes.

3. Scope of Maintenance

Maintenance includes the following:

  1. Maintenance of pump sets and other machineries, septic tank or sewage treatment plants Sanitary, Rain water Harvesting pits/ tanks, underground drainage system and electrical lines common in "The County Address"
  2. Payment of electrical and water charges for common services (excluding water charges payable by the members to the society / concerned authorities)
  3. Replacement of bullion streets, internal pathways, common areas and facilities
  4. Maintenance of area in "The County Address" ground space, children play area, internal roads, garden
  5. Maintenance of landscape, pots and other plants in "The County Address" and maintenance of swimming pool, club house, party area, recreation centre for indoor games etc. provided as common amenities
  6. Salaries and wages payable to the property manager, security guards, plumbers, electricians, gardeners, pumps and generator operators, administrative staff, vendors, employees of the cooperative Society etc.
  7. Payment of monthly/ yearly subscription and other charges payable to the club house
  8. Any other area of maintenance not specifically mentioned above

4. Maintenance Charges

Maintenance charges shall be levied as approved by the General Body and paid within the prescribed time.

5. Special Maintenance and Sinking Fund

The Society may create Sinking Fund and Repair & Maintenance Fund. Special contributions may be levied with General Body approval.

6. Responsibilities of Managing Committee

The Committee shall maintain common properties, prepare budgets, appoint vendors, maintain accounts, and place statements before the General Body.

7. Responsibilities of Members

Members shall pay dues promptly, avoid misuse of common property, and comply with Society rules.

8. Individual Repairs

Maintenance within individual plots/houses is the responsibility of members. Alterations affecting common services require prior approval.

9. Penalty for Default

Delayed payments may attract interest and action as per Bye-laws and KCSA provisions including the right to decide and remove such common benefits or amenities.

10. Use of Common Facilities

Common facilities shall be used only for intended purposes.

11. Dispute Resolution

Disputes shall be resolved by the Managing Committee, General Body, and as per KCSA if required.

12. Amendment

These Guidelines may be amended by General Body resolution.

13. Saving Clause

In case of conflict, KCSA 1959, Rules, and Bye-laws shall prevail.
